TERMS AND CONDITIONS OF SALE

Car Colour Services Ltd


1. Definitions

“Company” means Car Colour Services Ltd.
“Customer” means any individual, business, trade customer, or consumer purchasing goods from the Company.
“Goods” means all products supplied, including paints, coatings, consumables, aerosols, and custom mixed products.


2. Application of Terms

2.1 These Terms & Conditions apply to all sales made by the Company, including purchases made via:

  • Website

  • Trade counter

  • Telephone

  • Email

  • Credit account

  • Online checkout

2.2 By placing an order, accepting a quotation, purchasing goods, or otherwise entering into a contract with the Company, the Customer agrees to be bound by these Terms & Conditions.

2.3 These Terms take precedence over any alternative terms proposed by the Customer unless agreed in writing by the Company.


3. Trade and Consumer Customers

3.1 The Company supplies both trade (business) and consumer (retail) customers.

3.2 Where the Customer is acting as a consumer, nothing in these Terms shall limit or exclude their statutory rights under the Consumer Rights Act 2015 or other applicable UK consumer protection laws.


4. Product Suitability & Professional Use

4.1 Many products supplied by the Company are professional automotive and industrial coatings intended for competent and trained users.

4.2 The Customer is responsible for ensuring that:

  • The product is suitable for the intended application

  • Correct preparation and application procedures are followed

  • Manufacturer technical data sheets (TDS) are adhered to

4.3 Any technical advice, colour guidance, or application recommendations provided by the Company (whether verbal, written, or electronic) are given in good faith based on experience and manufacturer data and do not constitute a guarantee of performance under all conditions.


5. Custom Mixed Paint & Colour Matching

5.1 The Company provides custom mixed paints based on information supplied by the Customer, including but not limited to:

  • Vehicle registration number

  • Paint code

  • Variant selection

  • Spectrophotometer readings

  • Physical samples

5.2 Due to the nature of automotive refinishing, colour variations may occur due to factors including:

  • Ageing and fading of existing paintwork

  • Lighting conditions

  • Application technique

  • Substrate and preparation

  • Manufacturer tolerances and variants

5.3 Custom mixed, tinted, or made-to-order products are bespoke items and are non-returnable and non-refundable unless faulty or not as described.


6. Mandatory Colour Check & Spray-Out Requirement

6.1 The Customer must check colour accuracy by performing a spray-out card, test panel, or appropriate verification method before full application to any vehicle, panel, or surface.

6.2 Full use or application of the product without prior testing constitutes acceptance that the colour and product are satisfactory.

6.3 The Company shall not be responsible for colour mismatch claims where the Customer has failed to test and verify the colour prior to full application.


7. Limitation of Liability

7.1 To the fullest extent permitted by law, the Company’s liability is limited to:

  • Replacement of the goods supplied; or

  • Refund of the purchase price (at the Company’s discretion)

7.2 The Company shall not be liable for any:

  • Labour costs

  • Vehicle respraying costs

  • Materials or consumables

  • Loss of profit

  • Loss of business

  • Downtime

  • Indirect or consequential losses

arising from the supply, use, application, colour outcome, or performance of supplied goods.

7.3 Nothing in this clause shall exclude liability for death or personal injury caused by negligence or any liability that cannot be excluded under UK law.


8. Regulated, Solvent-Based & 2K Products

8.1 Certain solvent-based, isocyanate-containing (2K), and regulated coating products supplied by the Company may be subject to environmental, safety, and regulatory restrictions depending on their intended use, application environment, and user competency.

8.2 By purchasing such products, the Customer confirms that:

  • The products will be used lawfully and responsibly

  • They understand applicable UK and local regulations

  • They are competent and suitably equipped to use professional coating materials safely

8.3 The Company supplies regulated products in good faith based on the Customer’s stated or implied intended use and does not control or supervise the application, environment, or end-use once supplied.

8.4 The Customer is solely responsible for ensuring that the purchase, storage, handling, and use of regulated, solvent-based, or 2K products complies with:

  • UK laws and regulations

  • Health & Safety requirements

  • Environmental and VOC regulations

  • Any territorial legal restrictions

8.5 To the fullest extent permitted by law, the Company shall not be liable for any misuse, unlawful application, regulatory breaches, enforcement action, legal proceedings, or consequences arising from improper or non-compliant use of regulated products.


9. Orders & Acceptance of Goods

9.1 Customers must inspect goods upon receipt.

9.2 Any shortages, damage in transit, or obvious defects must be reported within 48 hours of delivery or collection. This does not affect the Customer’s statutory rights in respect of latent defects.

9.3 Goods must not be fully used or applied if a defect or issue is suspected.


10. Returns & Refunds

10.1 Custom mixed, tinted, bespoke, and made-to-order products are non-returnable unless faulty.

10.2 Stock items may only be returned with prior approval and must be:

  • Unused

  • In original condition

  • In original packaging

10.3 The Company reserves the right to apply a restocking fee where appropriate.

10.4 This policy does not affect consumer statutory rights where applicable.


11. Defective or Faulty Goods

11.1 Where a fault is alleged, the Company reserves the right to:

  • Inspect the goods

  • Request samples or batch information

  • Conduct technical review before accepting liability

11.2 No liability will be accepted for goods that have been fully applied or used before a defect is reported unless proven to be inherently faulty and the Customer has complied with the mandatory spray-out and testing requirements set out in Clause 6.


12. Online, Trade Counter & Telephone Sales

12.1 All sales, including trade counter and website purchases, are subject to these Terms & Conditions.

12.2 Acceptance of goods, payment of invoice, completion of checkout, or continued trading constitutes acceptance of these Terms.


13. Indemnity

The Customer agrees to indemnify and hold harmless Car Colour Services Ltd against any claims, damages, losses, or liabilities arising from:

  • Misuse of products

  • Unlawful application

  • Failure to follow technical guidance

  • Non-compliant use of regulated materials

to the extent permitted by UK law.


14. Investigation of Product Issues

14.1 The Company encourages customers to contact us directly to resolve any product concerns professionally and promptly.

14.2 The Company reserves the right to inspect, test, and technically investigate any alleged product defect or failure before accepting liability.

14.3 The Company shall not be liable for any consequential losses or claims arising where the Customer has failed to allow a reasonable opportunity for investigation prior to further use, repair, or remedial work.


15. Force Majeure

The Company shall not be liable for failure or delay in performance caused by circumstances beyond its reasonable control.


16. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.


17. Retention of Title

17.1 Title to goods supplied shall not pass to the Customer until full payment has been received by the Company.

17.2 Until title passes, the Company reserves the right to recover or reclaim goods supplied where payment remains outstanding.
